Civil Liability Insurance allows professional drivers to have a mechanism of indemnity

The representation in this eastern Cuban province of the National Insurance Company (ESEN in Spanish) reminded the professional drivers of the territory that there is still time to buy the Civil Liability Insurance, an operation they are obliged to do before April 9, as established by Decree-Law 11/20.

Las Tunas, Cuba.- Maidelín Barroso Martínez, director of the Basic Business Unit (UEB in Spanish) of the ESEN in Las Tunas, informed that up to now 584 drivers have already made the referred purchase, who receive remuneration for the activity they carry out through the payment of a salary or a fee. However, that number, she warned, is less than half of the identified potential of more than 1,200 professional state drivers who must comply with the decree published in the Ordinary Official Gazette No.70 last October.

The directive emphasized that the UEB under her command quickly took the pertinent measures to guarantee that these new sales are carried out.

“Firstly, she said, the institutions were visited to identify the personnel working as professional and administrative drivers responsible for the task. Then, she added, after agreeing on the date set for the sale and once it has been carried out, each agent attending the institution indicates how to contact him so that the driver can reach him and buy the insurance”.

Also, she insisted, a second visit date is arranged and if there are still drivers left to purchase the insurance, both parties must agree to continue the sale until 100 percent of the identified payroll is reached.

Civil Liability Insurance allows professional drivers to have a mechanism of indemnity in case of eventual personal, material, and consequential damages, which they involuntarily cause, as long as it is within the limit agreed in the policy with the insurer. Until now, its possession was only mandatory for private carriers, as part of their operating license granting process.

Barroso Martínez emphasized that this is a personal procedure and therefore it must be purchased directly by the driver, making the payment in cash, never through the entity's account. They will be able to contract the limits for different types of coverage previously established by ESEN and choose the one they believe to be the most feasible, she concluded.

The term of the insurance is one year, extendable for the same period of time, and will not apply when the damages are caused by intentional acts of the insured, thefts, or when the damages to the property of the insured or of his relatives within the fourth degree of consanguinity or second degree of affinity. Nor when they are the result of accidents occurring in places of prohibited access, civil or international war, riot, terrorism, earthquake or floods, soil or water pollution.

It shall also not be applicable if the damage is caused by acts in which the insured is recognized as responsible; without the consent of the insurer; by the use of the vehicle as a means for the commission of a crime; or by being incapacitated to drive at the time of the accident due to having ingested alcoholic beverages or psychotropic substances.
